Who are We?

Milton Babirak and Robert Lightburn are the team at Babirak Carr who specialize in providing all types of succession planning legal services including estate planning, estate tax planning, trust administration and probate administration legal services. What is our Experience?

The combined client experience of Mr. Babirak and Mr. Lightburn exceeds 70 years. Mr. Babirak has extensive legal experience in drafting all the documents necessary for successfully completing a personally tailored estate plan, including, but not limited to wills, revocable trusts, durable powers of attorney for both financial and health care matters, irrevocable life insurance trusts and second-to-die irrevocable life insurance trusts, family limited liability companies and family limited partnerships, and asset protection trusts. He also has significant experience with the probate administration of estates. Mr. Robert Lightburn has experience in probate administration and over thirty years of tax experience.

How Do We Work?

While each client is different with different needs and circumstances, typically there are four steps in preparing and executing an estate plan. The first step is for the client to complete a form Questionnaire which will be sent to him or her soon after the initial contact is made. The Questionnaire requests information about the family members (names, addresses, relationships, etc) as well as financial information (assets such as stocks, real estate, life insurance, retirement plans, etc) and how it is owned (jointly with a spouse, individually, joint tenancy). The second step is a meeting with the client and the attorney to review the overall goals of the client in the planning process, review special considerations the client may have, and review the completed Questionnaire. In this meeting, the nature of the planning process is explained, and a preliminary determination is made as to the type of documents that are needed.

The third step is the preparation of a draft of the estate planning documents based on the information from the initial meeting and the facts provided in the Questionnaire. These documents generally include a will, revocable trust, and powers of attorney for financial and health care matters for the client (two sets if the client is a married couple). This first draft is sent to the client for review. The client and attorney then meet to discuss the first draft. We address any questions and revisions that may be needed. A second draft is prepared and sent to the client for review. Frequently, any further questions or comments are handled by phone at this stage.

After the documents are finalized, there is a signing ceremony with the client, where the final documents are executed with the necessary legal formalities, including two witnesses and a notary. The process, from initial contact to completed estate plan, can take anywhere from a couple of days to several months, depending on the degree of complexity of the plan and the client’s needs.

The final step is to advise the client on the transfer of their assets to their estate plan. This is usually done in writing.

How We Charge for Our Services

Generally our estate planning engagements are done on a fixed fee basis which is determined at the time of the first meeting with the client. This fixed fee is determined based upon the complexity of the estate planning goals as well as the number and types of documents needed. The fixed fees are competitive with other practitioners in the field.

In certain instances we will work on an hourly basis. Most commonly, we work on an hourly basis if there are extraordinary circumstances that need to be addressed or resolved. Also, hourly fee arrangements are common when dealing with periodic reviews of estate plans which have been in place for a while and need revisions or amendment.
